A conservative legal group, New Civil Liberty Alliance filed a case against the Trump administration on Thursday for imposing Tariff on sugar imports,
Filed in the federal court in Florida, the case alleged that Trump had a lack of legal rights to implement the comprehensive tariffs unveiled on Wednesday and also under the International Emergency Economic Power Act (IEEPA) on 1 February.

NCLA senior litigation lawyer Andrew Morris argued that Trump imposed heavy tariffs on Chinese imports, “misused emergency powers”, “encouraged the Congress’s right to control tariffs, and harassed the separation of the forces of the Constitution.”
The NCLA filed a lawsuit on behalf of Florida-based retailers of home management products.
Trump announced on Wednesday that China would be hit with 34% tariffs, at the top of 20% at the beginning of this year, the total new levy was brought up to 54%.
The lawsuit asks a judge to block the implementation and enforcement of tariffs and to undo the changes of Trump in the US tariff schedule.

The lawsuit says that the President can only impose tariffs with the permission of the Congress and under complex trade methods, they can explain how and when they can be authorized.
“Such laws require a close fit between advance investigation, detailed factual conclusions and the scope of the legal authority and tariffs,” the lawsuit calls.
Trump has declared an emergency on China’s alleged complexity in the US Opioid epidemics, designed as a dialogue tool to eliminate the influx of deadly drugs.

The NCLA stated that its suit “is” not “with Trump’s opioid-related emergency declaration, but it issues its decision to do so without legal rights to do so.”
The case was assigned to US District Judge Kent Wethel, a Trump appointment who stopped a significant part of the former President Joe Biden Immigration Policy in 2023.
