Earlier this month, a jury found Tesla partly responsible for the death of 22 -year -old Nibel Benevides, who was killed by a model driver, who pledged to her and her lover Dillon Angulo. Tesla was ordered to pay $ 243 million to the families of the victims to the families of the victims, a surprising result for a company that has managed to avoid taking responsibility for accidents involving its partially autonomous software.
In filing, Tesla’s legal team said that the driver of the model bore all the responsibility for the accident. And they are requested to invaluate the verdict from the court, or at least a new jury test.
The company’s lawyers wrote, “The decision of $ 243 million against Tesla flies in front of Basic Florida Tort Law, Du Process Claus and Common Sense,” seeing that McGi had pressed the accelerator to overroid the autopylat in seconds before the accident. “Auto manufacturers do not insure the world against the damage caused by careless drivers.”
The lawyers also claim that the plaintiff should not have been allowed to enter the evidence statement of Tesla CEO Elon Musk, who has long claimed that the company’s vehicles are actually able to high levels of autonomy they are actually. And he called claims about data coverup on behalf of Tesla – the company was accused of withdrawing camera data from the police investigating the accident – there were false and “swelling” jury against the company.
The proposal was filed by Gibson Dun’s lawyers, a firm who represented Tesla in a trial against a former employee and a technical startup accused of stealing business secrets for a robot hand.
